ORDINANCES OF HORNER PARK DISTRICT Lebanon, Illinois St. Clair County, State of Illinois

As adopted by the Board of Commissioners of Horner Park District pursuant to Chapter 105, Illinois Revised Statues "The Park District Code," said Horner Park District, being a body corporate and a political subdivision of the State of Illinois, as organized on June 25th, 1957;
WHEREAS, the governing body of Horner Park District is authorized by law to establish by ordinance all needful rules and regulations for the government and protection of parks, boulevards, and driveways and other property under its jurisdiction and to prescribe such fines and penalties for the violation of ordinances as it shall deem proper and to establish fees for the use of facilities of said park district;

NOW THEREFORE, BE IT RESOLVED and ORDAINED by the Board of Commissioners of the Horner Park District, Lebanon, Illinois, County of St. Clair, State of Illinois, as follows:

SECTION 1: OPERATING HOURS
The Horner Park District park premises shall be open for use from 8:00 a. m. until dusk every day of the year. The premises shall be open for use and for vehicular traffic during the hours of 8:00 a. m. until dusk, Monday through Sunday, from the beginning to end of daylight savings time. The premises may be opened or closed at such other times at the discretion of the Horner Park Board of Commissioner's. It shall be unlawful for any person to be upon the premises other than at the times stated above as open for use unless specifically authorized by the Board of Commissioners.

SECTION 2: VEHICLES OPERATING ON ROADWAY, SPEED, PARKING.
a. It shall be unlawful for any person to operate any motor vehicle other than on roadways designated or posted as traffic ways by the Board of Commissioners or to operate a snowmobile or other tracked vehicle in any area unless specific permission is granted by the Board of Commissioners.
b. It shall be unlawful for any person to operate any motor vehicle at a speed in excess of 15 MPH.
c. It shall be unlawful for any person to operate or park a motor vehicle, bicycle, minibike, or motorcycle, or any motor vehicle in any prohibited area which is posted with signs, or to park any vehicle, as described above, in any area other than designated parking areas, except for the purpose of immediate repairs necessary to remove the vehicle from the area immediately.
d. Additional regulations as approved by the Board of Commissioners may be posted at the entrance to the park.

SECTION 3. WEAPONS AND FIREARMS
It shall be unlawful for any person, except authorized peace officers, to possess, display, or use on any land operated under the jurisdiction of Horner Park District, any gun including shotgun, rifle, pistol, revolver, air or BB gun, sling shot, bow and arrow, switchblade knife with spring loaded blade, throwing knife, tomahawk, or throwing axe, unless specifically authorized by the Horner Park Board of Commissioners in writing.

SECTION 4. ALCOHOLIC BEVERAGES
a. It shall be unlawful for any person to possess or consume alcoholic beverages on property operated by the Horner Park District with the exception of canned beverages.
b. Possession of half-or full barrels of beer must be approved by the Board of Commissioners not less than thirty days prior to transporting onto Horner Park property.

SECTION 5. ANIMALS - PETS, DOGS, CATS
a. It shall be unlawful for any person to allow or otherwise permit any pet, dog, or cat, or other domesticated animal to be upon any property operated by Horner Park District unless leashed or restrained at all times and under the specific physical control of the person who owns or has legal custody of said animal. Leashes must be no longer than 10 feet in length. All persons who bring pets, as described above, onto property operated by Horner Park District must have proof that the animal has a current valid rabies inoculation and valid licence.
b. It shall be unlawful for any person to bring or keep a noisy, vicious, or dangerous animal, onto Horner Park District property and remain thereon after having been asked to leave by any agent of the Horner Park District Board of Commissioners.
c. It shall be unlawful for any person bringing said animal, as heretofore described, not to remove and dispose of its animal waste in proper containers from park premises.
d. It shall be unlawful for any person or persons to allow any animal or pet to swim, wade or bodily enter into the water at any location or on any property under the jurisdiction of Horner Park District.

SECTION 6. BOATS, FISHING, SWIMMING, AND SKATING
a. It shall be unlawful for any person to operate any sailboat, rowboat, houseboat, pontoon boat or boat propelled by machinery or other watercraft in any pond, lake, or body of water on property under the jurisdiction of Horner Park District.
b. Fishing shall be conducted only from the banks of any pond, lake, or body of water. It shall be unlawful to fish from the Dam in Horner Park, or where otherwise posted. Persons under the age of 14 years shall fish only under the supervision of an adult at least the age of 18 years. No frogging shall be allowed. Fish size and catch limits will be posted seasonally. Fishing shall be prohibited except by use of a pole and line only.
c. It shall be unlawful for any person not a resident of the Horner Park District to fish without having paid the appropriate fees prior to the activity.
d. It shall be unlawful for any person or persons to swim, wade or bodily enter into the water at any location or on any property under the jurisdiction of Horner Park District.
e. It shall be unlawful to ice skate on the large lake in Horner Park.

SECTION 7. USAGE OF FACILITIES
a. All persons using park property shall dispose of litter in receptacles provided therefor.
b. No person shall build a fire except in designated fire pits and every person shall extinguish all fires prior to leaving the area.
c. It shall be unlawful for any person to use any amplified music device while on Horner Park property without prior approval of the Board of Commissioners.
d. Glass containers of any type are prohibited on park grounds.
e. All persons shall pay appropriate fees required by the Commissioners of Horner Park District prior to usage of any property of the Park the following fees apply:
1) Residents of Horner Park District may use all facilities without charge.
2) All persons age 14 and over not residents of Horner Park District must pay a $1.00 per day per person fee for use of the park property. All persons not residents of the Horner Park District must pay an additional $4.00 per day fee for fishing privileges.
f. It shall be unlawful for any person to injure or remove any animal, tree, or plant on Horner Park District property without prior approval of the Board of Commissioners.

SECTION 8. SPECIAL USES AND GROUPS.
a. It shall be unlawful to use any facility or area of Horner Park in groups of more than 25 persons without prior permission from the Board of Commissioners, Horner Park District;
b. It shall be unlawful for groups of 10 or more minor persons under the age of 17 years to gather in any area of Horner Park unless at least one responsible adult of the age of 21 or over accompanies each such group without prior permission from the Board of Commissioners.
c. Any group or organization desiring to use Horner Park must make a reservation for a specific location. Anyone wishing to use Horner Park for a money-making affair must notify the Park Board at least 30 days prior to the affair and must furnish satisfactory evidence of liability insurance in the amount specified by the Board. Sale of alcoholic beverages requires a liquor licence, and Dram Shop insurance must be furnished as specified by the Board. Reservations, notifications, and requests for approvals must be submitted to the Secretary, Horner Park Board, P. O. Box 58, Lebanon, or given directly to the Secretary. Reservations take priority over other uses. Reservations must be obtained from the Horner Park Reservations Supervisor prior to use. All requests for reservations shall be considered on a first applied-first granted basis.
d. Any person conducting a special event on Horner Park property shall furnish to the Park Board not less than thirty days prior to the event satisfactory evidence of insurance as determined by the Board to protect against personal liability and property damage due to damage of property and injury to persons as determined by the Board.

SECTION 9. PENALTIES FOR CONVICTION
a. That any person who violates any of the provisions of these ordinances shall upon conviction thereof, be fined not less than ten dollars ($10.00) nor more than two hundred dollars ($200.00) plus costs.
b. Any person who damages or destroys property shall be assessed the costs of repair or replacement of said property damaged or destroyed.

THIS ORDINANCE shall be in full force and effect from and after its due passage and approval as provided by law.
